Terms of Service

By creating an account or using Adscano you agree to these terms. Please read them carefully: they are a legal agreement between you (the workspace owner, agency or brand) and Nexivara, the business that operates Adscano. “We” and “us” below mean Nexivara.

1. The service

Adscano is online software that makes offline advertising measurable. It turns QR codes, printed images and short links into trackable landing pages, with lead capture, attribution, analytics and white-label reports.

2. Your account

• You must be at least 18 and able to enter contracts.
• Keep your password safe; you're responsible for activity under your account.
• One workspace per legal entity unless we agree otherwise in writing.
• Owners can invite team members and assign roles (Owner, Admin, Account Manager, Editor, Analyst, Client viewer). You're responsible for ensuring invitees consent to access.

3. Acceptable use

You agree not to use Adscano to:

• Spam, scrape, or send unsolicited communications to leads.
• Run campaigns for illegal products / services, or that target minors deceptively.
• Misrepresent the source of an ad creative or impersonate another brand.
• Run automated bots against our public endpoints or scrape the dashboard.

We reserve the right to suspend a workspace or campaign that violates these rules.

4. Lead data and consumer consent

When someone submits a lead form on a campaign you created, you decide how that lead's details are used. Under the Digital Personal Data Protection Act 2023 you are the Data Fiduciary and we act as your Data Processor (in GDPR terms, you are the controller and we are the processor). You are responsible for showing accurate consent text, handling access and deletion requests from the people whose details you collect, and complying with the privacy laws that apply to you.

5. Plans, billing, and refunds

• The Free plan has usage limits (campaigns, client brands, monthly scans and team seats), shown on our pricing page.
• Paid plans are billed monthly in advance through Razorpay, in INR, and prices include 18% GST. You can cancel any time; unused days in a paid month are not refunded pro rata. Our Refund & Cancellation Policy has the details.
• Agency plans add per-client rate cards. You set your own prices for your clients; we are not a party to your contracts with them.
• We may change pricing with 30 days' notice via email and an in-app banner.

6. Image-trigger feature

Recognising a printed image through a phone camera is best effort. It depends on the lighting and the angle the phone sees, so we do not guarantee that every scan of the image will be recognised. For important campaigns, also print a QR code on the creative as a fallback.

7. White-label and reports

On qualifying plans you can hide Adscano branding on shared landing pages and reports. The underlying links still run through Adscano's hosting. We do not support custom domains for these pages at this time.

8. Service availability

We work to keep Adscano available at all times, but we do not offer a contractual uptime guarantee (an SLA) on any plan today.

9. Intellectual property

• You retain ownership of everything you upload (logos, hero images, ad creatives).
• You grant us a licence to host, transform (resize, generate thumbnails / PDFs / recap videos), and serve those assets for the purpose of running your campaigns.
• We retain ownership of the Adscano platform itself.

10. Termination

Either side may terminate at any time. If you cancel, your data remains available for 30 days for export before deletion. We may terminate for breach (e.g. abuse, non-payment).

11. Liability

To the maximum extent allowed by law, our total liability in any 12-month period is capped at the fees you paid in that period. We're not liable for indirect or consequential losses (lost profits, lost leads, reputational damage).

12. Governing law

These terms are governed by the laws of India. The courts at Jaipur, Rajasthan have exclusive jurisdiction over any dispute arising from them.
